STATEMENT IN OPEN COURT

1. My Lord, in this action I appear for the claimants, Robert Murat, Michaela Walczuch and Sergey Malinka.

2. My friend Mr Mathieson appears for four newspaper groups, the publishers of ten different daily and Sunday newspapers. He appears for Associated Newspapers Limited, publisher of the Daily Mail, Evening Standard and Metro; Express Newspapers, publisher of the Daily Express, Daily Star, Sunday and Express and the book ‘Madeleine’; MGN Limited, publisher of the Daily Mirror and Sunday Mirror (as well as an associated company of the publisher the Daily Record, in Scotland) and News Group Newspapers Limited, publisher of the Sun and the News of the World. These newspapers have a combined circulation in the jurisdiction in excess of 15 million copies as well as a very substantial on-line readership.

3. My Lord, this libel action arises out of the very well known case of Madeleine McCann, the three year old girl who went missing from an apartment in the Portuguese holiday resort of Praia da Luz on 3 May 2007. Mr Murat, Ms Walczuch and Mr Malinka all live in or nearby Praia da Luz.

4. In May 2007 Mr Murat was setting up Romigen, an internet-based estate agency business with Ms Walczuch. He was brought up in Portugal but lived for many years in England where his daughter still lives with her mother, Mr Murat’s former wife. He lived with his mother in a villa in Praia da Luz close to the apartment complex from which Madeleine disappeared. Like many other concerned local residents, Mr Murat and his mother were heavily involved in the search for Madeleine McCann in the days after her disappearance.

5. Ms Walczuch is a friend of Mr Murat who now works as a translator for the German and British communities of the Algarve. She lives in Lagos with her daughter.

6. Mr Malinka is an IT consultant who has lived and worked in the Algarve for the last 8 years. One of his clients was Mr Murat and Ms Walczuch’s proposed new internet based real estate business. He was involved in the design of their website.

7. Following Madeleine McCann’s disappearance last year the defendants published nearly 100 articles about the case in their various newspapers which referred to one or more of the claimants and which were seriously defamatory. Many of these articles were published between May and Novermber 2007 but some were as recent as January this year. Almost all featured Mr Murat, and several featured Ms Walczuch and Mr Malinka. The stories were also published in online editions of the newspapers. Many of the articles were published on the front pages of the newspapers with sensational headlines and striking photographs.

8. The articles published by the defendants strongly suggested that Mr Murat had abducted or been party to the abduction of Madeleine McCann, had lied to Portuguese police about his involvement, and had otherwise obstructed the police investigation into her disappearance including giving false details of his whereabouts on the evening of 3 May 2007. Some of the newspapers suggested that Mr Murat had paedophile tendencies including an interest in child pornography and that he might have been part of a paedophile ring involved in the abduction. Other newspapers stated that Mr Murat’s behaviour was similar to that of the notorious Soham murderer, Ian Huntley. A false claim that DNA evidence had shown that Madeleine had been in Mr Murat’s villa was published. The allegations continued over a period of many months.

9. It was suggested that Ms Walczuch might have been involved in Madeleine’s abduction and that she had been seen with a young girl answering Madeleine’s description shortly after Madeleine’s abduction. Some of the newspapers also suggested that she had lied about her whereabouts on the night of Madeleine’s abduction, might have been part of a paedophile ring and had been cast out of her church.

10. Of the first three defendants, some published allegations that Mr Malinka was involved in Madeleine’s abduction with Mr Murat; some suggested Mr Malinka had lied about a telephone call to Mr Murat on the night of the abduction and about the extent of their acquaintance; others suggested that he was a sexual pervert who had convictions for sex offences, boasted of sex with young girls and had an interest in child pornography.

11. The defendants are here by their solicitor today to acknowledge that the allegations they published about the claimants are entirely untrue. In particular, the defendants accept that none of the claimants had any involvement whatever in the abduction of Madeleine McCann. They accept that none of the claimants has any paedophile tendencies or connection with paedophiles or paedophile websites and that none of them lied to the police or obstructed the investigations. They accept that Mr Murat’s actions after the abduction were entirely proper and were motivated by a desire to help find Madeleine McCann. He became a volunteer translator for the Portuguese police and did everything he could to assist the investigation. Ms Walczuch was never suspected or accused of any involvement in the abduction of Madeleine McCann. Mr Malinka was not guilty of any sexual misconduct and has no criminal convictions.

12. The defamatory allegations against Mr Murat, Ms Walczuch and Mr Malinka should never have been made are unreservedly withdrawn. The defendants wish to make unreserved apology for the false defamatory allegations which they published.

13. In recognition of the immense distress and damage which they have caused, all ten newspapers represented in Court today have agreed not just to join in the reading of this statement but also to publish reports of this statement and apologies. They have also agreed to pay very substantial libel damages to each of the claimants and to pay their legal costs.

15. The defendants apologise to each of the claimants for publishing false allegations about them. Madeleine McCann's parents will savage bungling Portuguese cops in a tell-all interview with chat queen Oprah Winfrey when they are cleared as suspects tomorrow.

For 317 days fuming Kate and Gerry have been gagged by their status as arguidos.

But at noon tomorrow a judge will formally lift the cloud of suspicion - as exclusively revealed in The People in April.

And the McCanns will finally be free to speak about the investigation into three-year-old Maddie's disappearance.

They are set to launch a stinging attack on US star Oprah's TV show - although her rival Barbara Walters is also vying to secure the first interview with the couple. The doctors, both 40, will either go to the States or speak from their home in Rothley, Leics.

Pals expect them to highlight more than a dozen basic errors by police in the four weeks after their daughter's disappearance on May 3 last year.

These include: FAILING to immediately seal off the crime scene in Praia da Luz, allowing vital forensic evidence to be lost in and around the McCann holiday apartment.

Failing to inform Spanish border cops until the next morning.

Waiting more than 48 hours before house-to-house inquiries began. DELAYING the decision to bring in child abduction specialists and ISSUINGa baffling series of different descriptions of suspects - including one primitive e-fit picture which resembled a "boiled egg with hair".

The McCanns will also round on cops for leaking details of the case to the Portuguese press in a bid to incriminate them.

Their spokesman Clarence Mitchell said last night: "Kate and Gerry will talk about the police inquiry once their arguido status has been lifted.

"They want to get their side of the story across. They want the weight of guilt by association lifted from their shoulders. And they will make it clear that they will continue to search for Madeleine, come what may."

The couple are likely to focus their fury on top cop Goncalo Amaral, who was kicked off the Madeleine case last October following allegations of incompetence and attacks on his British police counterparts.

Moustachioed Amaral, 48, sometimes worked little more than four hours a day and enjoyed long, boozy lunches.

He was also overheard telling of his suspicions that the McCanns killed their daughter.

Police still have NO idea what happened to Madeleine, who disappeared from her bed while her parents were eating out.

A friend said yesterday: "Kate and Gerry are furious. They've kept their thoughts private - because the Portuguese legal system left them no choice. It's been incredibly frustrating.

"They know the police have given up looking for Maddie, so they've nothing to lose. A string of mistakes were made. And police leaked things that were totally untrue. When it was reported that Maddie's DNA was found in their car, Kate and Gerry could only conclude someone was trying to frame them.

"Being suspects has put an appalling strain on them. Kate hasn't been able to go out without thinking people may be pointing a finger of blame.

"As soon as they're free to talk about the appalling way they have been treated, they will."

You know what the PJ are going to say about Kate tomorrow do you still think Madeleine is alive and safe?

The PJ are the problem, and Madeleine will never be found if no one looks for her.   Again, I think she is still in PDL, and I hope she is still safe...the last thing I want to see is the PJ digging up the ground in PDL.  When the PJ do drop the case, conducting a real search in PDL must happen, without the PJ supervising or getting involved in any way.

Kate and Gerry McCann formally cleared as Portuguese Attorney General shelves Maddie case

Kate and Gerry McCann have been formally cleared and the investigation into their daughter Madeleine's disappearance has been being shelved, the Portuguese Attorney General revealed today.

The couple are due to speak out tonight after the announcement in Portugal, which ends a nightmare that has seen them not only searching for their daughter but living under the cloud of suspicion.

Attorney General Fernando Pinto Monteiro said the investigation had found no evidence of a crime by the McCanns or Robert Murat, the British ex-pat who became the first official suspect in the case.

Mr Monteiro ordered that the investigation be halted although the case will remain on file if any new evidence emerges.

The McCanns are expected to ask for access to the police files to help their personal hunt for Madeleine, then three, who vanished from their holiday apartment in Praia da Luz in the Algarve last may.

Their spokesman, Clarence Mitchell, said: 'Kate and Gerry have now been informed of the attorney-generals statement from Portugal.

Its far too early to give their immediate reaction yet, but they are, of course, liaising closely with their lawyers in Portugal and Britain.

Once they have digested the content of the attorney-generals statement and any implications, they will give a reaction a little later this evening.'


The news comes as the disgraced former head of the investigation insisted Portuguese police were not trying to persecute the McCanns by naming them official suspects in her disappearance.

Goncalo Amaral claimed the decision to name them as arguidos in the case was not taken by police alone and stressed it was done based on the leads his team had at the time.

Mr Amaral, 48, was responsible for authorising the decision to make the couple official suspects last September.

He was widely criticised for ignoring potential leads because of his focus on the couple and his rigid belief that Madeleine died in their holiday apartment in Praia da Luz on May 3 last year.

But today, he stressed he still believed that is where she died as he revealed his frustration that he was not able to solve the case.

The evidence that we had gathered by the time that I left the case, pointed to the girl being dead - and having died inside the apartment, he told the BBC.


'I dont know what happened next. I can't say. We'll have to wait for the case files to be made public.'

The move last September to make both parents suspects was taken by various officials, not 'purely and simply by police', he said.

'There were others involved - public prosecutors and the national directorate of the Portuguese police.


'They all knew there was a necessity to put everything on the table, in light of the advances we had made... the combination of leads we had.

'There was no persecution. The police dont want to persecute anyone, just to investigate what happened in a given case.'

But Mr Amaral is set to deliver another heartbreaking blow to the couple with a new book promising 'explosive revelations' about the inquiry, to be released on Thursday.

The former detective today denied he was trying to profit from the three-year-olds disappearance and said it was an attempt to find the truth.

'People can say what they like. All I would say, is that Im trying to contribute to the discovery of the truth.

'I worked 27 years as a police officer - and my conscience cant accept that this is the first case that slipped through my fingers. I worked hard with colleagues, and its still unresolved.'

The memoir reportedly contains allegations that Madeleine died accidentally in her parents' care, and that they disposed of her body to cover up the death.

The McCanns, both 40, vehemently deny the claims. Friends say the couples legal team will study the book and had not ruled out bringing libel proceedings against him.
Mr Amaral was rumoured to be responsible for many of the lurid smears and bizarre leaks from inside the police inquiry.

They stopped abruptly when he was removed from the case last October, a month after the McCanns were made 'arguidos'.


His book is set to hit the shelves three days after Portugals attorney general is expected to announce the police inquiry will be 'archived'.

Gerry and Kate McCann have been told they will be officially cleared today over the youngsters disappearance.

The couple have been arguidos for 10 months after Maddie vanished in Praia da Luz, Portugal.

Their spokesman Clarence Mitchell said: All Kate and Gerry want is to be allowed to keep looking for their daughter and have this weight of guilt by association lifted from their shoulders. They will make it clear that they will continue to search for Madeleine, come what may. Yesterday a legal source close to GP Kate and heart consultant Gerry, both 40, said: They have been told that their status of arguido will be lifted.

Mr Mitchell added: They would welcome this. It is not going to bring Madeleine home but one bad aspect of the case will have gone.


But they will also be told Portugese police are dropping the hunt for their daughter.


They are closing the case as an unsolved mystery.

Doctor friends of the McCanns spoke to the English police

Payne suspected of paedophilia

Twelve days after Maddie disappeared, a couple revealed the strange behaviour of one of the groups members. Testimonies only reached the Judiciária in January this year

David Payne, one of the McCanns friends that were on holidays in the Algarve on the 3rd of May last year, when Madeleine disappeared, was suspected of paedophile behaviours.

The accusations were brought by a couple of friends that spent their holidays with part of the group in the summer of 2005 themselves also English doctors. Twelve days after the British girl disappeared,
Katherina and Arul could no longer keep the secret that had bothered them for two years and went to the police to make a statement. They revealed two conversations between Dave and Gerry, during which both revealed suspicious behaviour and indiciated sex with minors.

According to what CM was able to establish, the depositions were given on the 16th of May. But they only entered the process in January 2008 and are included in the 13th volume of the process files. At that point in time, Kate and Gerry were already arguidos, the rogatory letters had already been issued and the English, including Dave, showed their reluctance in returning to Portugal.

Touching the nipple

Katherina made a statement that was eight pages long. She reported holidays in Mallorca with several English [people], including the McCanns and the Paynes. Two incidents left her with serious doubts about the friends behaviour and lead her to create suspicions that were never confirmed.

The first one happened on a night when Gerry and Dave were talking about Maddie. Katherina does not know what they were saying but she remembers that Dave sucked on his fingers, pushing them into the mouth and pulling them out again, while his other hand traced a circle around the nipple, with a circular movement over the clothes. That was done in a provocative manner, recalls Katherina, who says that it stuck to her memory.

Days later, the scene repeated itself. The doctor saw Dave making the same gestures again, while he talked about his own daughter. Scared, Katherina said nothing about the incident. But she took special caution, asking her husband never to let the doctor come close to the bathroom when her daughter was having a bath.

Arul went to the police to tell the same story. Katherinas companion confirmed the gestures that were made by Dave during the conversation with Gerry but asserted that he wasnt aware that they were talking about Maddie. He did find the behaviour in extremely bad taste, but didnt see it being repeated.

The incident ended up forgotten in his memory and it was only the disappearance of Madeleine, who had also been with them on the Mallorca vacation, that revived it.

During the deposition, Katherina went even further and said she had associated the gestures to someone who likes to watch child pornography. I remember thinking whether he looked at the girls in a different manner, she concluded.

Friends from school days

Arul and Kate were friends from their school days. They have known each other for approximately 20 years and that was the motive that led the couple to accompany the McCanns on their holidays to Mallorca. Arul and Katherina did not know Fiona and Dave and they only met again once, during a dinner that gathered several couples. When Maddie disappeared from the Ocean Club, Katherina remembered the incident in Mallorca. And she immediately tried to verify whether Dave had again been accompanying the McCann couple, as the suspicions about his behaviour still stood. In the deposition that was made to the English police, Katherina says she decided to give a statement when she saw the tv images. Dave was among the same holiday group.

Doubts in the case

Irishman not heard An Irishman who was spending holidays in Praia da Luz also went to the English police to report that on the night of the 3rd of May he saw Gerry carrying Madeleine towards the beach. He was never heard through a rogatory letter.

Sending delayed

The difference between the date when the deposition was obtained and the time when it was sent is not explained in the process.CM knows that the English authorities did not provide an explanation, either.

Bank account info

The PJ tried to know the bank account situation of every element of the group, in order to search for possible motives for the crime. But the English answers were laconic and did not help the investigation.

Life stories

The life stories of Gerry and Kate McCann remain unknown. The PJ tried to verify whether Maddies mother suffered from depression but never received her clinical records, because the judge did not allow it.

Kate accused of conditioning the case

An intercalary report from the Polícia Judiciária, which was produced immediately before Kate and Gerry were made arguidos, accuses Madeleines parents of having conditioned the investigation. The document is signed by an inspector and was directed to Gonçalo Amaral, who was then coordinating the process.

The investigator then stated that the information that had been collected initially, was worked by the group in order to sustain the abduction theory. He guarantees that they all lied to protect themselves and even suggests that some could have been covering the crime up.

The testimony from Janne Turner [sic], who guarantees that she saw a man crossing the street with a child in his arms, is also questioned. The policeman said that Janne [sic] was only two or three metres away from Gerry but he failed to see the man. And that, by stating that the man was headed towards Murats house, she ended up orienting the investigation into a false direction, which led to an unnecessary waste of time.

The same report exposes other contradictions in the Englishs depositions. Kate and Gerry say that they picked up their children from the crèche at 5.30 p.m., but while the former guarantees that they went for a half-hour run on the beach and only then returned to the apartment, her husband states that they went to play tennis during that period.

After that, at around 8 p.m., one of the elements of the group reportedly went to the apartment that had been rented by the couple. Kate says that he was there only for 30 seconds and then left. Gerry speaks about half an hour. The policeman remembers that the time difference is what is needed between asking whether everything is well, or advancing in case a crime has to be concealed.

Another situation that the authorities found strange was the fact that Kate, upon realizing that Maddie had disappeared, remained inside the apartment for ten minutes. Only then did she ask for help, leaving the twins asleep in their cots while she returned to the restaurant. The policeman who wrote the report asks how it is possible that a mother facilitates the safety of her other children when it is certain that by that time she was already screaming that her daughter had been abducted.

They could not see the apartment

Another contradiction was pointed out by the inspector who was in charge of the Maddie case. The policeman remembered that the McCanns asserted that their position inside the restaurant was a strategic one, so they could see the apartment where their children were sleeping. But according to several testimonies, Kate and Gerry had their backs turned to the apartment.

Following Carol Everett’s mention of a villa with a big security gate/remote controlled, it could be what you have been drawing for many months - arched entrance gate with the number 272 & Madeleine in a basement with the number 217, that is linked to the number 272, supposedly in PDL.

Carol sees the area with mountains possibly in Germany (with new mention of Austria too) - perhaps links to her ‘Fat Man’ from Frankfurt Germany that Carol says has an electrical shop with dodgy videos out the back, & perhaps the 217 that you mention is Madeleine’s room number in this place with the big gate or orphanage/school that Carol mentions.

Perhaps there are German links to having a holiday home in PDL & snatched her away from there? For example the Casa Niobe with the pyramid in the garden is German owned & apparently the owners are hardly ever there, but could be any other villa too, so I don’t want to point a finger at one place really.

Under normal circumstances Madeleine should be at school at 5 years old, but she couldn’t possibly be attending the usual primary school full of so many children with parents coming & going, because of the obvious high risk of being seen, even though she may have darker hair, tinted glasses to cover her eye marking & must have a new name too …..

(remember the clairvoyant ‘Neo’ from ‘The Missing Still Speak’ site that has also mentioned the number 217 as well as you & I believe it was him that has said that Madeleine’s new name could be Megan, I think it was. Unfortunately, his site is down at the moment to be able to re-check it, but I may have the text saved somewhere)

…. But looking at Wikipedia under Education in Germany, it states that some 3 - 6 year old children attend Kindergärten run by churches, so probably taught by nuns being a Catholic country & I believe that would be more discreet to keep Madeleine tighter under cover. So it could be more of a Convent perhaps for just girls, with the big gate that you & Carol mention.

And going by Carol’s description of Madeleine’s school uniform, having a Unicorn in gold thread on her blazer pocket, that may give a bit of a clue, as Unicorns have been known to be linked to religion & the Virgin Mary, if you Google Unicorns.

“The collective name for a group of unicorns is a “blessing of unicorns” so it’s likely the creature is mixed up another great source of hope, namely, religion. The single horn of a unicorn was believed to neutralize poison; it was the good to heal the bad. Another handy use for unicorns was in deducing whether a woman was a virgin or not. Only virgins could tame a unicorn (as we know virgins, and the Virgin Mary herself rate very highly in the catholic religion), and seemingly only a virgin could mount a unicorn. So if he kicked her off then you knew someone was telling porkies.”

Anyway, I hope Carol’s information gets to the German/Austrian police to check it out. The UK police should have already received it.
